Special City Council Meeting in McLendon-Chisholm Tonight

 

Dear RCH Members,

We want to inform you about a special City Council meeting in McLendon-Chisholm tonight. This meeting is significant for RCH Water Supply Corporation, and we urge all members to stay informed and engaged. Several agenda items could directly affect our operations and, by extension, you.

Key Points on Tonight’s Agenda:

  1. Notice Letter to RCH
    Discussion on directing RCH not to collateralize any City property or assets.
  2. Termination of Water License Agreement
    Consider terminating the 2014 water license agreement between RCH and the City for Sonoma Verde.
  3. Legal Action Against RCH
    Consider authorizing a lawsuit against RCH, seeking an injunction against RCH Water Supply Corp., including claims of TOMA violations on September 13, 2024, and prior incidents.

We have consistently followed the Texas Open Meetings Act (TOMA), including posting the required notice on September 9th for our September 13th special meeting. However, the City Council has yet again failed to clarify the violation they claim RCH committed. This lack of transparency shows that certain council members continue to push an obstructionist agenda.

Additionally, the potential lawsuits that will ensue from terminating the water license agreement between Sonoma Verde and RCH will impose a significant financial burden on RCH Members and McLendon-Chisholm taxpayers (costs that are not currently accounted for in the City’s budget and will unnecessarily increase water bills). This will further strain the community’s finances. Moreover, pursuing injunctions against RCH without legal basis may delay critical projects, such as the NTMWD direct connection, which is vital for ensuring reliable water access for our members. These actions are unjustified and risk hindering progress that benefits both RCH and the broader community.

The ongoing lack of transparency, frivolous allegations, and refusal to work with RCH, alongside the City’s insistence on pushing an agenda already rejected by the PUC, make it clear that McLendon-Chisholm has no interest in partnering with RCH for the good of the community.

We are deeply disheartened by these continued attempts to obstruct RCH’s efforts, which ultimately burden our members. Rest assured, RCH remains committed to transparency and serving the best interests of our members.
